These Terms & Conditions govern your use of the Sirene website and the design services provided by Sirene ("we", "us", "our"), a kitchen design studio registered in Petaling Jaya, Selangor, Malaysia. By using this website or engaging our services, you accept these terms.
1. Definitions
- "Service" — any of the three kitchen design services offered by Sirene: the Brief and Workflow Conversation, the Detailed Kitchen Documentation package, and the Sourcing and Installation Oversight service.
- "Client" / "You" — the individual or entity engaging Sirene for design services or using this website.
- "We / Us / Our" — Sirene, the kitchen design studio.
- "Documentation" — the drawings, schedules, 3D views, and written materials produced as part of the design services.
- "Engagement" — a confirmed service arrangement between the Client and Sirene.
2. Acceptance of Terms
By submitting an enquiry through this website, confirming an engagement by email, or making a payment, you confirm that you are aged 18 or above and have the legal capacity to enter into an agreement. Use of this website constitutes acceptance of these terms.
3. Services Provided
Sirene provides interior design services for kitchens, operating within the scope of non-regulated design practice. Services include concept development, layout planning, materials specification, documentation preparation, supplier sourcing, and on-site installation oversight. Services do not include structural engineering, electrical certification, gas fitting certification, or any other regulated professional activity.
4. Service Fees and Payment
- Fees are stated per service: RM 460 (Brief and Workflow Conversation), RM 2,750 (Detailed Kitchen Documentation), RM 1,820 (Sourcing and Installation Oversight).
- All fees are in Malaysian Ringgit (RM) and inclusive of applicable taxes where stated.
- Payment terms are confirmed in the engagement letter or email. Typically, a deposit is required before work begins, with the balance due upon delivery of the final documentation or at the end of the engagement period.
- Fees for engagements outside the standard scope will be agreed in writing before additional work is undertaken.
5. Refunds and Cancellations
- Cancellation before the brief session or first documented meeting: deposit refunded in full, less any reasonable administrative costs.
- Cancellation after the brief session but before documentation work begins: deposit retained to cover time spent.
- Cancellation mid-documentation: fees for work completed to date are retained; any balance is refunded.
- Cancellation of the sourcing and oversight service: fees for sourcing work and site visits already completed are retained.
Refunds are processed within 14 working days of the written cancellation request.
6. Revision Process
The Detailed Kitchen Documentation package includes two structured revision rounds. A revision round is defined as a consolidated set of changes submitted in a single written communication. Changes submitted after the two revision rounds, or changes that represent a significant shift in scope or design direction, may be subject to an additional fee agreed in advance.
7. Client Responsibilities
- Provide accurate information about the site, existing conditions, and project requirements in a timely manner.
- Respond to review requests and revision feedback within the agreed timeframe. Delays in feedback may affect the project timeline.
- Obtain all necessary approvals, permits, and permissions from the relevant authorities for construction or fit-out work. Sirene's documentation is a design tool and does not constitute a building permit or regulatory approval.
- Ensure that the cabinet maker, contractor, or other trades engaged independently have the appropriate licences and qualifications for the work they are undertaking.
8. Intellectual Property
All documentation, drawings, materials schedules, and design work produced by Sirene remains the intellectual property of Sirene until full payment for the relevant service has been received. Upon full payment, the Client is granted a non-exclusive licence to use the documentation for the purposes of the specific kitchen project for which it was prepared. The documentation may not be reproduced, shared, or used for other projects without written permission from Sirene.
9. Disclaimers
- Sirene's documentation is prepared with professional care but does not constitute a structural, electrical, or mechanical specification. Clients are responsible for engaging appropriately qualified trades for all regulated work.
- Material pricing, availability, and specifications are subject to change. Sirene provides recommendations based on information available at the time of the engagement but does not warrant the ongoing availability or pricing of specified materials.
- Sirene does not accept responsibility for errors introduced during installation that were not identified during site visits, where site visits were not part of the agreed engagement scope.
10. Limitation of Liability
To the fullest extent permitted by Malaysian law, Sirene's liability in connection with any engagement is limited to the fee paid for that engagement. Sirene is not liable for indirect, consequential, or special damages arising from the use of our services or documentation, including but not limited to construction delays, cost overruns, or third-party contractor errors.
11. Termination
Either party may terminate an engagement with written notice. Where Sirene terminates, fees for work completed to date will be invoiced and the remainder refunded. Where the Client terminates, the provisions in Section 5 (Refunds and Cancellations) apply. Termination does not affect intellectual property rights or confidentiality obligations.
12. Governing Law and Disputes
These terms are governed by the laws of Malaysia. In the event of a dispute, both parties agree to attempt resolution through good-faith negotiation before referring the matter to the courts of Malaysia. The courts of Selangor shall have exclusive jurisdiction where legal proceedings are necessary.
13. Changes to These Terms
We may update these terms from time to time. The date at the top of this page indicates the most recent revision. Continued use of the website or services after an update constitutes acceptance of the revised terms. For active engagements, the terms in place at the time of engagement confirmation apply unless both parties agree otherwise in writing.
